Drilling and working in groundwater

Drilling operations that reach so deep into the ground that they could come into contact with groundwater must be reported and, in some cases, require a permit

Course description

Drilling operations that only penetrate Quaternary gravel and are not located within a water protection area may commence one month after receipt of the notification accompanied by the full documentation, provided that the works have not been prohibited within that period.​

Drilling operations subject to notification that only penetrate Quaternary gravel and are not located within a water protection area include, for example:

  • unlined boreholes such as exploratory boreholes and ground investigation boreholes
  • groundwater monitoring points
  • Wells for the thermal utilisation of groundwater using a heat pump or cooling system
  • Installation of a geothermal probe​
  • Installation of a well for garden irrigation

You will require a permit under water law for the following boreholes (see ‘Boreholes requiring a permit under water law’):

  • through layers protecting groundwater (clay, sand, silt)
  • through multiple aquifers
  • into pressurised water

Important note

Important note

The maximum groundwater level is the decisive factor for the reporting obligation.

If groundwater is tapped unintentionally, this must be reported immediately to the Department for Climate and Environmental Protection (Water Law Section).

Required documents

The documents should preferably be submitted digitally.

  • Completed notification form
  • General site plan M 1:25,000 with marking of the location
  • Detailed site plan M 1:5,000 or M 1:1,000 with entry of the project
  • Expected layer profile of the subsoil (for groundwater measuring points with schematic expansion plan)

Processing time

One month at most.

Water law permit - building in flood areas

A water law permit is required for the construction or extension of buildings in flood areas.

Display for a garden fountain

If you wish to install a well to irrigate your private garden with groundwater, you must give at least one month's notice.

Report tree damage (during construction work)

If trees are damaged without authorisation, owners or polluters can be obliged to restore or plant replacement trees.

Water law permit - geothermal probe/ geothermal collector

A permit under water law is required for the construction of a geothermal system (probe, collector, baskets or similar) with groundwater contact.

Completion of the replacement planting

If you have felled a tree, a replacement planting may be required as compensation. The completion of this replanting must be reported.

Water licence - heat pump/ cooling system up to 50kW

If you operate a heat pump or cooling system and extract or infiltrate groundwater via wells, you will need a permit under water law.

Tree felling - protected landscape areas

If you want to cut down a tree or make other changes to a tree in a landscape conservation area, you must submit an application.
