Description
Employers’ duty to notify regarding residence permits
If you employ foreign nationals, you must check whether they are permitted to take up employment. If a contract of employment is terminated early, you must notify the Immigration and Naturalisation Service of this. This applies in particular to employment under a residence permit pursuant to Sections 18a to 19f of the Residence Act, for example for skilled workers.
This notification must be made within four weeks; the period begins as soon as the department responsible for human resources in your company becomes aware of the premature termination of employment.
Obligation to notify in the case of a training or employment permit
If employment under a training or work permit is terminated prematurely, you must notify us of this within two weeks.
The obligation to notify does not apply if
- the planned employment has not yet commenced, or
- a fixed-term employment contract has been terminated no more than one month before the agreed end date.
To notify the Immigration and Naturalisation Service (Munich Foreigners Office), please use our online contact form and select:
- ‘I have a question’
- Category: “Issue or renewal of a residence permit”
- Type of residence: “Residence for gainful employment/work”
- Subject: “Employers’ duty to notify”
The Immigration and Naturalisation Service will then assess the implications for foreign nationals under residence law.
Important note
If you fail to comply with your obligation to report, this may be treated as an administrative offence and result in a fine of up to 30,000 euros.
Requirements
The employment or training of a foreign national was terminated or discontinued prematurely.
Required documents
- Surname, first name, date of birth and nationality of the employee
- Company name and contact details
- Date of termination of employment

In some cases, further documents may be required.
