Drilling and working in groundwater

Work that penetrates so deeply into the ground that groundwater could be encountered must be reported at least one month before the planned start of work.

Course description

Boreholes that only tap the quaternary gravel and are not located in the water protection area may be started one month after receipt of the notification with complete documentation, provided that the work has not been prohibited within this period

The maximum groundwater level is decisive for the obligation to notify.

If groundwater is tapped unintentionally, the Department of Climate and Environmental Protection (Water Law Division) must be notified immediately.

Boreholes that only require notification, which only tap the quaternary gravel and are not located in the water protection area, include, for example

  • undeveloped boreholes such as exploratory boreholes and ground soundings
  • Groundwater measuring points
  • Wells for the thermal utilisation of groundwater by means of a heat pump or cooling system
  • Construction of a geothermal probe
  • Construction of a well for garden irrigation

Drilling through groundwater-protecting layers (clay, sand, silt), through several groundwater levels or into pressurised water requires a permit under water law (see link to "Drilling requiring approval under water law" under "Documents and links")

Required documents

The documents should preferably be submitted digitally.

  • Completed notification form
  • General site plan M 1:25,000 with marking of the location
  • Detailed site plan M 1:5,000 or M 1:1,000 with entry of the project
  • Expected layer profile of the subsoil (for groundwater measuring points with schematic expansion plan)

If you intervene in the groundwater during a construction project, a permit under water law is required.

Water law permit - geothermal probe/ geothermal collector

A permit under water law is required for the construction of a geothermal system (probe, collector, baskets or similar) with groundwater contact.

Report tree damage (during construction work)

If trees are damaged without authorisation, owners or polluters can be obliged to restore or plant replacement trees.

Tree felling - protected landscape areas

If you want to cut down a tree or make other changes to a tree in a landscape conservation area, you must submit an application.

Completion of the replacement planting

If you have felled a tree, a replacement planting may be required as compensation. The completion of this replanting must be reported.

Water licence - heat pump/ cooling system up to 50kW

If you operate a heat pump or cooling system and extract or infiltrate groundwater via wells, you will need a permit under water law.

A water law permit is required for the construction or extension of buildings in floodplains.

Display for a garden fountain

If you wish to install a well to irrigate your private garden with groundwater, you must give at least one month's notice.

Advice on the ecological criteria catalogue

If you want to build on a municipal property, you must comply with the ecological criteria catalogue of the City of Munich. We can advise you on this.
