Water law permit - building in flood areas

A permit under water law is required for the erection or extension of structures in an identified and mapped floodplain.

Required documents

All documents are required at least in quadruplicate on paper and also digitally at wasserrecht.rku@muenchen.de

  • Informal application
  • Explanatory report with information on the planned project and detailed concept for simultaneous equalisation of the retention area (retention area)
  • Open space design plan with drawing of the flood protection measures/retention area compensation
  • General site plan

Depending on the individual case, further documents may be required in accordance with the WPBV (Ordinance on Plans and Supplements in Water Law Proceedings).

Duration & Costs

Processing time

The processing time is four weeks to three months, depending on the complexity of the case.

Fees

Up to 0.6 per cent of the construction sum, depending on the work involved.

Completion of the replacement planting

Drilling for the construction of extraction and absorption wells for groundwater heat pumps or cooling systems must be notified in good time before drilling work begins.

Tree felling - Protected tree species

In Munich, certain trees are specially protected by the Tree Protection Ordinance. These trees may only be cut down or pruned with authorisation.

If you want to cut down a tree or make other changes to a tree in a landscape conservation area, you must submit an application.

Drilling and working in groundwater

Work that penetrates so deeply into the ground that groundwater could be encountered must be reported at least one month before the planned start of work.
