Special use of urban public green spaces

Anyone wishing to set up a construction site in a public green space or drive on the green space requires a special permit.

Description

Urban public green spaces are, for example, landscaped parks and green areas, recreational and leisure areas, sports and play areas, outdoor swimming areas, sunbathing lawns and children's playgrounds. They are usually signposted as public green spaces.

Prerequisites

For every special use of a municipal green space, we must consult the Building Department for Horticulture (as the landowner). Only once we have received written approval from the Building Department can we issue an exemption licence.

Required documents

You can submit your application by e-mail, fax, post or by making an appointment by telephone.

You will need the following documents for your application in any case:

  • Fully completed application form (available for download)
  • Site plan or hand-drawn sketch (in accordance with the specifications on the application form)
  • MVAS certificate for the person named in the application and responsible on site

Duration & Costs

Processing time

The processing time depends on the scope of your construction project:

  • Smaller building sites: The application processing for such measures currently takes about 3 weeks.
  • Medium to large construction sites: The processing time is currently around 6 weeks.

The processing time already includes consultation with the municipal building department. The processing time is shorter if you already have a permit and only need to extend or postpone the period subsequently.

When planning your schedule, please bear in mind that you need the permit in good time so that you can erect the signs at least four days before the validity date.

Fees

  • Administrative costs: 3 to 250 euros (depending on expenditure)
  • Special utilisation fees in accordance with the green space fee statutes (available for download, see "Forms and downloads")

Legal basis

  • Green space statutes (statutes on the use of municipal public green spaces)
  • Cost statutes (statutes on the levying of administrative costs for official acts within the City of Munich's own sphere of influence)
  • Green space fee statutes (statutes on fees for the use of green spaces in the City of Munich)
  • Guidelines for the safety of roadworks under traffic law (RSA21)
