Construction measures in public transport areas

Anyone who digs up the ground on public paths, roads or squares, stores or sets up anything, blocks off areas or lays pipes requires a permit.

Description

Anyone who wants to dig up the ground on public roads, streets or squares for a construction project, store or set up something, cordon off an area or run an electricity or water line in the airspace needs two types of permit:

  • A special use permit, as public road land is being used for special purposes.
  • An order under traffic law, as road traffic may be affected.

Required documents

You can submit your application by e-mail, fax, post or by making an appointment by telephone.

You will need the following documents for your application in any case:

  • fully completed application form for private or public construction project
  • MVAS certificate for the person named in the application and responsible on site
  • Traffic sign plan (four copies) and, if applicable, road marking plan

Duration & Costs

Processing time

  • Minor roadworks are measures that do not interfere with the carriageway. Pedestrian and cycle traffic can be safely routed on the remaining width of the footpath or cycle path. It currently takes up to 2 weeks to process applications for this.
  • Medium to large roadworks exceed the scope of smaller roadworks. Processing currently takes 8 to 10 weeks.

The processing times stated correspond to the status as of 14 October 2024.

The processing time is shorter if you already have a permit and only need to subsequently extend or postpone the period. However, the processing time may be longer if

  • there is a conflict with other uses
  • the involvement of other authorities is required,
  • Measures exceed a duration of 3 months,
  • Excavations have to be carried out or
  • Parking ticket machines with power connections have to be dismantled (currently plus 12 weeks).

Questions & Answers

  • How much noise can my construction site generate?
    According to the Federal Immission Control Act, anyone operating construction sites must prevent avoidable noise, limit the spread of unavoidable noise and protect the neighbourhood from noise pollution. There are guide values for different areas and for day and night times. Please find out about the applicable noise protection regulations.
  • Can I hang advertising on my site fence?
    Advertising on construction fences is permitted without a permit if it relates solely to the company working on the construction site and does not exceed an area of one square metre. More extensive advertising measures require a permit for advertising installations.
  • What do I have to bear in mind if my construction site is located in a pedestrian zone?
    Anyone wishing to access construction sites in the pedestrian zone requires an access permit for the pedestrian zone.
  • Who needs an MVAS certificate and what is it?
    The responsible person on site named in the application for the work site must present this when submitting the application. A copy of the certificate must be enclosed with the application. The MVAS certificate serves as proof of the specialist knowledge required to secure work sites on roads.
