Immission control licence - application

Course description

An industrial plant requires an immission control licence before it is erected and commissioned if

• it causes particularly high levels of air and noise pollution or
• it contains certain quantities of hazardous substances and
• the installation is to be operated at the same location for longer than twelve months.

a list of these installations can be found in the Annex to the Ordinance on Installations Requiring Authorisation ( 4th BImSchV).

Prerequisites

If you are planning the construction and operation of a system that requires a permit, please contact the responsible approval authority in good time before purchasing or renting and/or before finalising the planning documents.

In the city of Munich, this is the Department for Climate and Environmental Protection.

Plan ahead and inform the authorisation authority of any changes to the planning status at an early stage.

Include future expansion plans (both structural and mechanical) in the planning from the outset. This includes, for example, the introduction of shift operation, the addition of further input materials or an increase in throughput quantities.

If you are planning the construction and/or operation of a waste disposal plant, you should answer the catalogue of questions on waste disposal plants (PDF) in advance and, if necessary, contact other authorities in consultation with the Department of Climate and Environmental Protection.

• For the planning location, you can clarify in advance with the local building commission in the Department of Urban Planning and Building Regulations (Planning Department) whether your project is eligible for planning permission.
• Questions relating to land drainage can be clarified in advance of the actual approval procedure with the Munich Urban Drainage Department, Land Drainage Division, which is part of the Building Department.
• Questions regarding groundwater protection can also be answered in advance by the Water Law Department in the Department for Climate and Environmental Protection.

Selecting suitable planners and commissioning external experts

Commission a competent planner who is specifically suited to your project. If in doubt, seek advice from the Chamber of Industry and Commerce.

If the involvement of external experts is necessary due to possible effects on the neighbourhood (e.g. due to noise and odour development), discuss the person of the expert and the necessary scope of the expert opinion with the approval authority (Department for Climate and Environmental Protection) in advance.
