Course description

Please note that only the following purposes of the declaration of commitment can be processed directly at the appointment on site:

short-term stay up to 90 days

You pay for the person travelling to Switzerland:

• All living expenses that they cannot cover themselves
• All social benefits that the state incurs (such as for housing/care in the event of illness)
• All costs incurred if the authorities send the person back to their home country

Prerequisites

As a host, you must have your main residence in Munich and have a regular, attachable income.

It is only possible to submit the declaration of commitment if you can prove your financial capacity. When checking your ability to pay, the garnishment exemption limits according to §§ 850 ff. ZPO including existing statutory maintenance obligations.

Proof of creditworthiness for visits

Creditworthiness is successfully proven by the submission of income if the portion of earned income that can be seized in accordance with Section 850c ZPO for each adult guest is half of the standard subsistence requirement and, in the case of accompanying children, a quarter of the standard subsistence requirement per child.

Proof of creditworthiness for stays to study / language course / job search

Creditworthiness is successfully proven by the submission of income if the garnishment amount of EUR 992 of the attachable portion of earned income in accordance with § 850c ZPO is available.

Proof of creditworthiness for stays with an opportunity card

Creditworthiness is successfully proven by submitting income if the garnishment amount of EUR 1,027 of the garnishable portion of earned income in accordance with Section 850c ZPO is available.

Special feature for long-term stays: If you have a temporary residence permit for Germany, this must be valid for longer than the duration of the obligation (5 years).

Notes on legal persons

Legal entities based in Germany can also submit a declaration of commitment (such as companies). Please write to us using the contact form and ask for the required documents.

if you wish to submit a declaration of commitment, you must visit us in person. You will need an appointment for this, which you can arrange online. If you cannot find a free appointment immediately, you do not need to worry.

We also open up additional appointments every day on Monday, Wednesday and Friday at 7.30 am and on Tuesday and Thursday at 8.30 am. Please only call up the calendar from this time onwards, otherwise the appointments will not be visible to you

If you fulfil all the requirements for submitting a declaration of commitment, you can obtain this directly at your appointment.

Required documents

Inviting person:

• Form for issuing a declaration of commitment
• Declaration on the issuance of a formal obligation
• Instruction on the storage and use of application data in the VIS
• Valid passport / passport substitute or identity card (third-country nationals: passport or passport substitute required)
• Employees:
  • 3 current payslips (also from secondary employment) or
  • Confirmation of employment: please only have this completed by the employer if no payslip is available
• Pensioners: a current pension statement
• Self-employed/freelancers: current tax assessment notice and confirmation from your tax advisor about your profit and loss account (for the past three months). If you do not have tax advice, you must prepare an overview of your net profit for the past three months yourself. This must be signed by you.
• Other regular income from letting and leasing: current tax assessment notice and a current surplus statement (income less expenses)
• from investment income: current tax assessment notice and current financial status/deposit statements

When are the documents still up to date?

A tax assessment notice should generally not be older than 2 years. The wage or salary statement should not be older than 3 months.

Further documents may be required in individual cases.

The following information is required from the person invited from abroad:

• Surname, first name(s)
• Date of birth, place of birth
• Nationality
• Residential address in home country
• Copy of passport (digital form is sufficient)
• Date of expected entry/ start of the obligation
