Residence permit – Sustainable integration

Tolerated persons or holders of the right of residence with an opportunity (§ 104c AufenthG) can receive a residence permit if they have integrated sustainably.

Description

On 31 December 2022, the so-called Opportunity Residence Act came into force. Tolerated persons can obtain a residence permit in accordance with Section 25b AufenthG under simplified conditions.

Before your tolerated stay or residence permit expires, you must apply for a residence permit.

To apply, please send us your application form and the required documents online or by post. After we have checked your application, you will receive an appointment from us.

  • Spouses, life partners and unmarried children who are minors can also obtain a residence permit for a shorter period of stay, provided that there is a family cohabitation and the conditions for granting the permit are met.
  • Persons with a tolerated employment permit in accordance with § 60d AufenthG can apply for a residence permit after 30 months of tolerated residence.
  • The residence permit is issued and extended for a maximum of two years.

Prerequisites

  • Registration of main residence in Munich
  • Valid national passport or at least clarified identity
  • Possession of a residence permit in accordance with § 104c AufenthG or a tolerated stay permit
  • Uninterrupted legal residence of six years or four years (in the case of domestic cohabitation with a minor, unmarried child) in the federal territory
  • Predominantly securing a livelihood through gainful employment or when considering the previous education, training, income and family situation,
  • Income and family situation, it is to be expected that the livelihood will be secured
  • Possession of sufficient oral German language skills (level A2)
  • Commitment to the free democratic basic order
  • Basic knowledge of the legal and social order and living conditions in the federal territory
  • For school-age children: Compliance with school attendance periods
  • Fulfilment of the security requirements: No conviction for intentional criminal offences totalling more than 50 daily rates or more than 90 daily rates in the case of criminal offences under immigration law and no existing interest in deportation pursuant to Section 54 AufenthG

Required documents

  • fully completed application and indication of your ID
  • valid passport, passport substitute or other identity document
  • if applicable, proof of the efforts made to clarify your identity and obtain a valid ID and travel document
  • current confirmation of employment and the last three payslips
  • Confirmation from the job centre that no social benefits - including housing benefit - are being received or, if benefits are being received, proof of social benefits (benefit notification)
  • Proof of oral German language skills at A2 level (language certificate or certificate of at least a secondary school leaving certificate)
  • Proof of basic knowledge of the legal and social order and living conditions in Germany
  • successful participation in the "Living in Germany" test or
    • corresponding school-leaving certificate (at least secondary school leaving certificate)
    • current school certificate for school-age children
  • Tenancy agreement stating the size of the flat in square metres and bank statements showing the rent amount or a certificate of residence

We offer health counselling by specially trained staff in accommodation centres. Our employees come to the accommodation centres for this purpose.
