Posters for elections and political events - exemption authorisation
Anyone wishing to put up posters for elections or political events on public roads outside the authorised areas requires a special permit.
Description
Requirements for the installation of poster stands and posters
- A responsible person within the meaning of press law (V.i.S.d.P.) must be clearly printed on the front of each individual poster, including the organisational e-mail address if applicable. Accordingly, each poster stand must also be clearly and weatherproof labelled, for example on the inside.
- Until the posters are taken down, care must be taken to ensure that the poster stands and posters are not misused by third parties, for example for non-election or event-related party advertising, advertising for other events or advertising with a commercial background.
- The authorisation does not apply to the erection of poster stands and posters in public green spaces, pedestrian zones or market areas. Posters are prohibited at the Platz der Opfer des Nationalsozialismus.
- The poster stands and posters must be set up in a storm-proof manner. Anchoring in the street is prohibited.
- Poster stands and posters must be in direct contact with the ground and may not be placed on top of each other or on top of each other. Hanging or attaching posters in the air (e.g. on lampposts and similar) is prohibited.
- Poster stands and posters must not touch trees.
- Poster stands and posters must be set up in such a way that they do not obstruct or endanger road users. Traffic facilities must not be impaired in their effect and must remain freely accessible. This also includes posts to which litter bins are attached.
- Poster stands and posters may not be erected:
- in formats larger than one square metre (DIN A 0)
- if the top edge of the poster, including the poster support, is above the maximum height of 1.80 metres from the ground
- on pipes and poles of all traffic signs directed at moving traffic (danger signs, directional signs, overtaking bans, speed limits, priority regulations and others)
- on tubes and masts of traffic facilities (traffic lights, parking meters, public transport stop signs, internally illuminated traffic signs and illuminated columns, barriers and beacons and others)
- at traffic lights and in pedestrian areas around traffic lights
- up to ten metres from the intersection of the edges of the carriageway before and after junctions and intersections
- within a ten-metre area before and after pedestrian and school crossing points as well as heavily frequented entrances and exits such as car parks, petrol stations or supermarkets
- along the entire length of bus stops and stopping bays and within a ten-metre radius of waiting, boarding and alighting areas
- along the entire length of disabled parking spaces and within a 5-metre radius before and after the associated parking signs
- on central reservations between carriageways and carriageway dividers
- on traffic and bus stop islands of all kinds
- on motorways, motorways and all roads with a maximum permitted speed of more than 50 km/h
- on overpasses and bridges and in subways
- on cycle paths or cycle traffic facilities of any kind
- if a clear remaining pavement width of at least 1.60 m is not guaranteed
- if a safety distance of at least 30 cm from the edge of the carriageway and cycle paths is not maintained on pavements
- within pedestrian zones and at pedestrian zone signs
Prerequisites
- Posters before elections, referendums and citizens' petitions, referendums and citizens' decisions
- Posters of political parties, voter groups and candidates are permitted
- Duration: up to three months before the election or referendum date
- Removal of posters: no later than 14 days after the election
- Posters outside election campaign periods (before political events)
- Posters of political parties, voter groups and campaign alliances to which at least two parties belong are permitted
- Duration: up to six weeks before the event
- Removal of posters: no later than 14 days after the event
- Posters can be put up again within the maximum installation period of six weeks. This means that the individual poster stand can only be used to advertise further events if the relevant authorisation has been obtained.
- The posters must clearly state the location and time of the event.
- The use of posters depicting people is permitted.
- Posters for general activities with politicians (e.g. cycle tours, Schafkopft tournaments, photo exhibitions) are permitted.
- Not permitted are
- Posters with political attacks on third parties
- Posters purely advertising political parties without any background to the event
Required documents
An application form is available for download. The application form contains the following information:
- Name, address and telephone number of the applicant candidate, political party, voter group, campaign alliance (with at least two parties), authorised representative of the grouping
- Date and topic of the event
- Number of posters put up per district
