Residence permit - contract workers

Description
These are employees who are employed by a company in one of the following third countries (Bosnia and Herzegovina, North Macedonia, Serbia or Turkey). The foreign local employment relationship continues to exist and you are posted to Germany by your company, which has become the contractor for a contract for work and labour in Germany. The Federal Employment Agency must approve this posting in advance.
Visa procedure
Before travelling to Germany, you must apply for a visa at a German diplomatic mission abroad. The German diplomatic mission decides on the visa application and does not involve the Foreigners Office.
After entering the country
You must first register your residence at the Citizens Office.
Application for a residence permit
You must apply for your residence permit before your visa/residence title expires. Please submit the application form and the required documents online or by post. After your application has been checked, you will receive an appointment from us for a personal interview. At this appointment, your fingerprints will be taken for your electronic residence permit
Period of validity
If you are working here on the basis of an intergovernmental agreement for employment under a contract for work and labour, you may stay in Germany for two years. If the work contract is valid for longer than two years, you can stay here for a maximum of three years.
If the place of work specified in the Employee Card is in the city of Munich, the Munich Foreigners Office is responsible for your application.

- You come from Bosnia and Herzegovina, North Macedonia, Serbia or Turkey
- The Federal Employment Agency has approved your work as a contract worker
Required documents
- Fully completed application form
- Valid passport or passport substitute
- Biometric passport photo (only at the appointment, photo machines can also be found at the Foreigners Office)
- Contract worker card
Further documents may be required in individual cases.
Legal basis
The authorisation of foreign contract workers is based on the intergovernmental agreements concluded by the Federal Republic of Germany with the Central and Eastern European states and Turkey since the end of 1988 on the posting and employment of workers from foreign companies on the basis of contracts for work and services.
