Show construction measures not requiring a procedure

Certain building projects can be carried out without a procedure, i.e. without planning permission. However, you must notify the building supervisory authority before starting.

Course description

All construction projects that can be carried out without a procedure are listed exhaustively in Article 57 of the Bavarian Building Code (BayBO). The following construction measures that do not require a procedure must be notified two weeks prior to commencement:

  • Repair work(Article 57 Paragraph 3 Sentence 4 BayBO)
  • Loft conversions for residential purposes, including the erection of dormers, if the roof structure and the external appearance of the building are not otherwise changed (Article 57 Paragraph 7 BayBO)
  • Changes of use in accordance with Article 57 Paragraph 4 Number 1 BayBO (Article 57 Paragraph 7 BayBO)

Notifications must be submitted to the local building commission.
If you are not sure whether your project is exempt from the procedure, please contact the Service Centre of the Local Building Commission.

  • Projects that do not require a procedure must comply with all public law regulations in the same way as projects requiring authorisation.
  • In justified cases, it is possible to apply for deviations, exceptions or exemptions if regulations cannot be complied with.

Required documents

  • The notification of a construction measure that does not require a procedure must be submitted informally in text form as an email to plan.ha4-anzeige-verfahrensfrei@muenchen.de.
  • Please state the client and the address at which the measure will be carried out.
  • No special documents are required.

At the service centre, you can find out whether your project is exempt from procedures and which regulations apply to your property. The staff will inform you about necessary deviations or exemptions and in which areas carports in front of a building line / building boundary are excluded.
