Description
Anyone wishing to approach passers-by on public property in order to conduct a commercial survey or commercial market research requires a special use permit.
- Permission is only granted to market research institutes to "recruit" participants for a consumer survey. The actual survey must then be conducted on private premises. Permission can be granted for a maximum of one year and for a maximum of two interviewers per institute.
As a rule, no special use permit is required if passers-by are interviewed as part of the so-called "communicative public use". This includes, for example
- if flyers, magazines or brochures are distributed free of charge and non-commercially,
- if no structures or information stands are used for this purpose (such as a collection of signatures with a clipboard),
- and if the questions are mainly focussed on general ideological, religious, historical or political opinions.
