Monument protection

Anyone wishing to remove, alter or relocate monuments or parts thereof requires a permit in accordance with the Bavarian Monument Protection Act.

Course description

A planning permission requirement also applies to work carried out on the exterior of buildings situated within ensembles or in the vicinity of listed buildings or ensembles. Excavations in the vicinity of archaeological sites also require permission under heritage protection legislation.

Important note: In the case of listed buildings, the protected area generally encompasses not only the façade but also the interior of the building, and may also include ancillary buildings and structures such as boundary walls.

Information on whether a building is a listed building, is situated within an ensemble or near a listed building or ensemble, or whether an archaeological site is affected by a planned excavation can be found in the Heritage Atlas published by the Bavarian State Office for the Preservation of Historical Monuments: https://geoportal.bayern.de/denkmalatlas/ If you have any further questions, the staff at the local heritage protection authority will be happy to advise you. Certain projects may be carried out without a heritage protection permit, i.e. without requiring authorisation. These projects are exhaustively listed in Articles 6 and 7 of the Bavarian Monument Protection Act (BayDSchG). Even if no authorisation procedure is required, all public law regulations must still be observed.

An application for a heritage protection permit must be made using the form below. In the case of a planning permission procedure, the planning permission generally replaces the heritage protection permit: a separate application for a permit is not necessary in this case. This does not apply to permits for excavation work in the vicinity of archaeological sites: in such cases, a heritage protection permit must be applied for separately in addition to the planning permission.

  • In the case of excavations within an archaeological site: site plans with detailed illustrations of the planned excavation work
  • Information on previous consultations with the heritage protection and/or planning authorities
